How to Get an EB-5 Investor Visa for the USA

Steps to Apply for an EB-5 Visa
1. Meet the Investment Requirements
o Investment Amount: Invest at least:
$1,050,000 in a standard area, or
$800,000 in a Targeted Employment Area (TEA), which includes rural areas or areas with high unemployment.
o Job Creation: Your investment must create or preserve at least 10 full-time jobs for U.S. workers.
2. Choose a Qualifying Investment
o Invest directly in your own business or an existing one.
o Invest through a USCIS-approved Regional Center, which pools funds from multiple investors and typically focuses on projects in TEAs.
3. File Form I-526E (Immigrant Petition by Regional Center Investor)
o If investing in a Regional Center, file Form I-526E.
o If making a direct investment, file Form I-526 instead.
o Include supporting documents such as evidence of the lawful source of investment funds and business plans demonstrating job creation.
4. Obtain Conditional Permanent Residency
o Once your I-526/I-526E is approved, apply for conditional permanent residency:
If you are outside the U.S., file Form DS-260 with the U.S. embassy/consulate.
If you are already in the U.S., file Form I-485 to adjust your status.
5. Remove Conditions on Residency
o After two years, file Form I-829 (Petition by Investor to Remove Conditions).
o Provide evidence that your investment met job creation and other requirements.
6. Receive Permanent Residency
o Once Form I-829 is approved, you will receive a permanent green card.
