The Canadian government has announced a significant update to the Start-Up Visa Program (SUV). As of October 3, 2024, entrepreneurs applying through the SUV can now apply for an open work permit. This new work permit allows business owners to work for any employer in Canada while they grow their business, instead of being restricted to working only for their own company, as was the case with the previous closed work permit.

To qualify for the new open work permit, applicants must have applied for permanent residence through the Start-Up Visa program and received an Acknowledgement of Receipt (AOR) from Immigration, Refugees and Citizenship Canada (IRCC). Additionally, applicants must intend to live outside of Quebec, as the Start-Up Visa program does not apply in that province. This new option provides more flexibility, enabling entrepreneurs to earn extra income while still focusing on building their businesses.

For those who applied before October 3, 2024, and received a closed work permit, there is still a chance to switch to the new open work permit. Applicants can reapply online with necessary documentation such as their AOR letter, proof of funds, and a medical exam. If their original application hasn't been processed, they will receive a refund for the $155 processing fee. However, applicants must ensure they apply for the open work permit before withdrawing their previous application to avoid losing their authorization to work.

Entrepreneurs must also prove they have enough money to support themselves and their families for one year while living in Canada. The required amounts vary depending on family size, starting from $29,380 for a single individual and increasing with each additional family member. Acceptable proof of funds includes cash, property documents, or other assets that can demonstrate the applicant’s financial stability.

Family members of SUV applicants also benefit from this change. Spouses or common-law partners can apply for their own open work permits, while dependent children can apply for study permits to attend school in Canada. Entrepreneurs interested in applying for the open work permit can do so online, ensuring they submit all required documentation to avoid delays in processing.
