Canada has introduced new regulations for its Open Work Permit (OWP) programme, effective January 21, 2025, impacting spouses of high-skilled temporary foreign workers and international students. The changes aim to streamline applications while prioritizing highly skilled workers in critical sectors.
Under the updated rules, only spouses or common-law partners of foreign workers employed in TEER 0 or 1 occupations, or select TEER 2 or 3 roles in government-priority or labor-shortage sectors, are eligible for an OWP. Dependent children are no longer eligible for the permit under this scheme. Applicants must have a valid passport, meet health and security requirements, and demonstrate sufficient funds to support themselves during their stay.
The application process involves creating an account on the Immigration, Refugees and Citizenship Canada (IRCC) website, completing the application form, uploading supporting documents such as proof of relationship and employment, paying the CAD $255 application fee, and providing biometrics if required. Processing times typically range from six to ten weeks.
Authorities emphasize that the principal applicant’s work permit must remain valid for at least 16 months after submission of the spouse’s OWP application. Applicants are advised to ensure all documents are accurate and complete to avoid delays. The revised rules are expected to help Canada focus on attracting skilled talent while providing clarity and structure for family members seeking work opportunities.
