IRCC Introduces New Policy for Open Work Permits

Immigration, Refugees and Citizenship Canada (IRCC) has introduced a new policy to make it easier for foreign workers in Canada to apply for an open work permit (OWP). This policy applies to foreign workers who have shown interest in a Provincial Nominee Program (PNP) by submitting an Expression of Interest (EOI). The policy is valid until December 31, 2024, and successful applicants can get a work permit for up to two years. To qualify, workers must already be employed in a province or territory and have a signed agreement with IRCC.

To be eligible for the OWP, workers must either hold a valid work permit, have one that expired after May 7, 2024, and have applied for status restoration, or have an approved or pending work permit extension. Applicants also need to submit a letter from their employer and a support letter from the provincial or territorial government confirming their place in the EOI pool or PNP.

Applicants must stay in Canada or be in the process of restoring their temporary resident status when the decision is made. If they leave Canada, the application will be canceled. All applications must be made online, as applications at the Canadian border are not allowed.

If granted, the OWP will be valid for up to two years or until the applicant’s passport expires, whichever is sooner. Fees for the application include $155 for the work permit, $229 for status restoration (if applicable), and $85 for biometrics. Additionally, the applicant’s spouse or partner can also apply for an open work permit, and children may apply for a study permit or attend school, depending on their status in Canada.
